Probate and Real Estate - What is Muniment of Title

 

Muniment of Title - Can be used when there is a will and no debts other than debts secured by a lien on real estate.

 The Muniment of Title process is most often used to transfer Real Estate from the decedent to the beneficiaries when there are no other debts. Unlike other probate processes, this process will not have a specific person acting on behalf of the estate.   

Benefits of this process include completing the title transfer of Real Estate quicker with less cost

Obstacles of this process include difficulties in transferring none real estate assets such as stock, bank accounts, and such because no one person is acting on behalf of the estate.
